Rush-Co. Marine warrants to the original purchaser of a Rush-Co. Marine Boat Lift Cover utilized as a boat lift canopy, when properly installed, will remain in good visual condition for a period that expires on the last day of the final warranty year. The start date of the warranty is based on the original owner’s actual invoice date. This warranty applies only to failure due to workmanship or material defects and excludes fading or matching separate canopy fabrics, subject to the following terms, provisions and conditions:

In the event of failure following the date of sale, Rush-Co. Marine provides the following pro-rated warranty schedule: Rush-Co. will pay for a portion of the replacement and the original purchaser will pay a portion of the prevailing retail price at time of warranty/replacement as per the chart below. In the event that Rush-Co. chooses to repair the cover at any time during the warranty period, the customer will not be charged for the repair.

7-Year Warranty Terms apply to Rush-Co. lift canopies made with Seaman Shelter-Rite® fabrics.
The pro-rated 7-year schedule will be as follows:
Year 1,2,3	Rush-Co. will pay 100% of replacement value. Consumer pays 0%
Year 4	Rush-Co. will pay 60% of replacement value. Consumer pays 40%
Year 5	Rush-Co. will pay 40% of replacement value. Consumer pays 60%
Year 6	Rush-Co. will pay 20% of replacement value. Consumer pays 80%
Year 7	Rush-Co. will pay 10% of replacement value. Consumer pays 90%
*An original invoice or photo copy must be presented at the time of warranty to establish date of purchase or    year 7 will be used.

5-Year Warranty Terms apply to Rush-Co. lift canopies made with WeatherMax™ fabrics.
The pro-rated 5-year schedule will be as follows:
Year 1,2,	Rush-Co. will pay 100% of replacement value. Consumer pays 0%
Year 3	Rush-Co. will pay 60% of replacement value. Consumer pays 40%
Year 4	Rush-Co. will pay 30% of replacement value. Consumer pays 70%
Year 5	Rush-Co. will pay 15% of replacement value. Consumer pays 85%
*An original invoice or photo copy must be presented at the time of warranty to establish date of purchase or    year 5 will be used.

Failure which can be attributed to improper installation of the canopy, or to distortion of the framework upon which the Rush-Co. Marine Canopy is mounted, is not covered by this warranty. No free repair or prorated replacement will be made for any canopy subsequent to the 5- or 7-year periods covered by this warranty, or at any time for damage resulting from negligence, vandalism, acts of God, chemically induced degradation (strong cleaning products), rodent damage or petroleum product damage.

If Rush-Co. is not able to determine warranty through digital inspection means, the consumer will be responsible for shipping charges to Rush-Co. for a pre-warranty inspection as well as shipping charges back to the consumer if the cover is not deemed warrantable.

The foregoing constitutes Rush-Co. Marine sole warranty with respect to Rush-Co. Marine Canopies, and all other representation, warranties, guarantees or conditions, be they expressed, implied and tacit, are hereby excluded. The liability of Rush-Co. Marine hereunder is limited to repair, prorated replacement as aforesaid and in no event shall Rush-Co. Marine be liable for consequential or special damages of any type whatsoever.
